1. IMPORTANT INFORMATION

You should carefully read the following Terms and Conditions. Your purchase or use of our products implies that you have read and accepted these Terms and Conditions.

2. LICENSE

Our website grants you non-exclusive limited license to use the web templates, skin, mods and other products sold through our web site in accordance with these Terms and Conditions (the "license") issued by our company. The MyCubeCart.com copyright notice must remain visible in the footer of the every page at all times. In addition to the price of the product purchase, a copyright removal fee of $49.99 can be paid to have the copyright notice removed. Without exception, unauthorized removal of said copyright notice will forfeit your rights to any support or upgrades and may result in legal action to recover our loses.

Providing the domain in which the MyCubeCart.com product will be used is a requirement with your purchase. Domains in which the CubeCart software solution is not running require prior approval before the purchase of the product. This requirement is implemented in an effort to eliminate fraudulent transactions and maintain a valid proof of purchase with your product.

a) LIMITED USAGE GRANTED

You may use each individual product on a single website only, belonging to either you or your client. You have to purchase the same template once more in order to make another project with the same design.

Under no circumstance are you permitted to redistribute or resell any of the pay or free mods, skins and other MyCubeCart.com products. If found in violation, the appropriate legal action will be taken.

Purchases may only be made by individuals or development firms, group purchases are strictly prohibited. If purchases are found to be made on behalf of a group of individuals, legal action will be taken.

b) IMAGERY, CLIPARTS AND FONTS

All imagery, clipart and fonts used in our templates are royalty-free and are the integral part of our products. Limited-usage License gives you the right to use images, clipart and fonts only as a part of the website you build using your template. You can use imagery, clipart and fonts to develop one project only. Any kind of separate usage or distribution is prohibited.

c) MODIFICATIONS

You are authorized to make any necessary modification(s) to our products to fit your purposes.

d) UNAUTHORIZED USE

You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from our company.

e) ASSIGNABILITY

You may not sub-license, assign, or transfer this license to anyone else without prior written consent from MyCubeCart.com.

f) OWNERSHIP

You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of independent content providers. Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.

3. OUR REFUND POLICY

Since MyCubeCart.com is offering non-tangible irrevocable goods we do not issue refunds after the product is shipped, which you are responsible for understanding upon purchasing any article at our site. Please make sure that you've carefully read 'sources available' section. We only make exceptions with this rule when the product appears to be not-as-described on a case by case basis in agreement of the parties concerned. The deadline for any refund claim is one week after the delivery date. The refund is issued to you after we receive a Waiver of Copyright signed by you. This is a required condition.

4. ANTIFRAUD CHECK

Customer purchase can be suspended for manual antifraud check for 10-20 minutes as well as it can be suspended for longer term (around 20 hours) for more serious investigation. Antifraud check occurs because of growing number of fraud transactions from persons who are not actual cardholders of the credit cards used during purchase.

5. CHARGEBACK POLICY

Should a chargeback be issued by accident or on purpose MyCubeCart.com will attempt to resolve the situation with the purchaser. If the chargeback is still processed the support account linked to the purchase in question will be deactivated along with any products associated with the chargeback. All product licenses will expire immediately.

If the chargeback has not been completed: To have the support account and/or products to be activated again MyCubeCart.com will need the following:

  • Chargeback to be resolved and stopped.
  • A $55 chargeback fee

If the chargeback has been completed: To have the support account and/or products to be activated again MyCubeCart.com will need the following:

  • Repayment of all funds that were charged back.
  • A $75 chargeback fee

If no action is taken to resolve the chargeback:

  • All products will remain deactivated
  • Support for the account and products will be terminated
  • Purchaser will be unable to purchase from MyCubeCart.com in the future

Our company reserves the right to change or modify current Terms with no prior notice.
